Browsing and submission of a purchase order on this site implies acceptance of the Terms and Conditions and Data Protection Policies adopted by the site and indicated thereon.

Art. 2 - Subject
1. These General Terms and Conditions of Sale regulate the offer, submission, and acceptance of purchase orders for products on Circular-design.it and do not regulate the supply of services or the sale of products by subjects other than the seller found on the same site through links, banners or other hypertext links.
2. Before placing orders and purchasing products and services from others, we suggest that you check their terms of sale.
Art. 3 - Conclusion of the contract
1. To conclude the purchase contract, it is necessary to fill in the electronic form and send it by following the instructions provided.
2. It contains reference to the General Terms and Conditions of Sale, images of each item and its price, the methods of payment that can be used, the method of delivery of purchased products and the related shipping and delivery costs, reference to the conditions for exercising the right of cancellation, how and when you are able to return purchased products.
3. Before concluding the contract, you will be asked to confirm that you have read the General Terms and Conditions of Sale, including the Notice on the right of cancellation and processing of your personal data.
4. The contract is concluded when the seller receives the form filled in by you, after you have checked that the data contained on it is correct.
5. You are obligated to pay the price the moment the online ordering process is completed. This is done by clicking on the "Complete order" button at the end of the process.
6. Once the contract is concluded, the seller takes charge of your order to fill it.
Art. 4 - Registered Users
1. During completion of registration procedures, you are obliged to follow the instructions on the site and provide your personal data correctly and truthfully.
2. Your confirmation shall in any case exonerate Circular-design.it from any responsibility regarding the data you provided. You are bound to promptly inform Circular-design.it of any change to your data.
3. If you provide inaccurate or incomplete data even in the case in which there is a dispute by data subjects regarding the payments made, Circular-design.it shall have the right not to activate or to suspend the service until the related shortcomings have been remedied.
4. On the occasion of the preliminary request made by you for activation of your profile, Circular-design.it shall assign a username and a password to you. The latter acknowledges that such identifiers constitute the system of validation of your access to the Services and the only system capable of identifying you and the actions performed through such access shall be attributed to you and be binding on you.
5. You are obliged to keep your access data secret and with due care and diligence and not allow them to be used, even temporarily, by third parties.
Art. 5 - Availability of the products
1. Availability of the products refers to actual availability at the time you place your order. Such availability must however be considered purely indicative because, when several visitors are browsing our site at the same time, the products could be sold to other customers before confirmation of your order.
2. Even after the order confirmation e-mail is sent, there may be cases where some or all items are unavailable. In this eventuality, the order will be rectified automatically with elimination of the unavailable item and you will be informed immediately by e-mail.
3. If you request cancellation of an order, thereby terminating the contract, Circular-design.it shall reimburse the amount paid within 15 days from the moment in which Circular-design.it becomes aware of your decision to terminate the contract.

Art. 7 - Payment methods and prices
1. The price of the products is the one indicated from time to time on this site unless there is an obvious mistake.
2. In case of a mistake, circular-design.it will inform you as soon as possible to allow for confirmation of the order for the right amount or its cancellation. Circular-design.it is not at all obligated to supply what has been sold at a lower price indicated by mistake.
3. The prices on this site include VAT and do not include shipping costs. Prices are subject to change at any time. The changes do not affect orders for which order confirmation has already been sent.
4. Once the items you want have been selected, they are added to your cart. Simply follow the purchase instructions and enter or verify the required information at each step of the process. Order details may be changed prior to payment.

Art. 8 - Delivery
1. Circular-design.it makes deliveries throughout Italy, excluding Vatican City State and the Republic of San Marino.
2. Circular-design.it shall only make deliveries to the address you provide when making the purchase.
3. Delivery shall be made, in Italian territory, generally within 2 working days, except in the event of delays on the part of the express courier not directly attributable to Circular Design. If no delivery date is specified, delivery is made within the term estimated at the time the delivery method is selected and, in any case, within a maximum term of thirty days from the date of confirmation.
4. As far as European Union countries are concerned, delivery shall be made in 5 working days, except in case of delays by the express courier and therefore not directly attributable to Circular Design, and in any case, within the maximum term of thirty days.
5. If delivery is not possible, your order will be sent to a warehouse. In this case, a notice will specify the location of your order and how to arrange for another delivery.
6. If you are unable to be at the place of delivery at the agreed time, please contact us again to agree on another delivery date.
7. If for reasons not attributable to us, delivery cannot take place after thirty days from the date on which the order is available for delivery, we will assume that you wish to terminate the contract.
8. As a result of termination, the amounts paid, including delivery costs, will be returned without undue delay, except for any additional costs arising from the choice of a delivery method other than the standard method offered and, in any case, within 14 days from the date of termination of the contract. Transportation resulting from termination of the contract may involve additional costs that will be borne by you.
9. Shipping costs are charged to the buyer and are explicitly highlighted at the time the order is placed.
Art. 9 - Transfer of risk
1. I rischi relativi ai prodotti passeranno a carico dell'acquirente a partire dal momento della consegna. La proprietà dei prodotti si considera acquisita appena ricevuto il pagamento completo di tutti gli importi dovuti in relazione agli stessi, incluse le spese di spedizione, ovvero al momento della consegna, se questa avvenisse in un secondo momento.
Art. 10 - Warranty and commercial conformity
1. The seller is responsible for any defect in the products offered on the site, including the non-conformity of the items to the products ordered, in accordance with the provisions of Italian law.
2. If you enter into the contract as a consumer, i.e. a natural person who has come to the site for purposes which are outside his or her trade, business or profession, this warranty is valid under the following conditions: the defect becomes apparent within 24 months from the date of delivery of the products; you submit a formal complaint regarding the defect within a maximum of 2 months from the date on which you found the defect; the online return form is correctly completed.
3. In case of non-conformity, if you enter into the contract as a consumer, you are entitled to obtain the restoration of conformity of the products without charge, by means of repair or replacement, or to obtain an appropriate price reduction or termination of the contract for the goods in question and the consequent refund of the price.
4. All return costs for defective products are borne by the seller.
Art. 11 - Withdrawal
1. In accordance with the provisions of law in force, you have the right to withdraw from the purchase without penalty and without specifying any reason, within a period of 14 days pursuant to Art. 57 of Legislative Decree 206/2005 starting from the date of receipt of the products.
2. In case multiple items are purchased in one order and delivered separately, the 30-day deadline starts from the date of receipt of the last item.
3. If you wish to exercise the right of withdrawal from the purchase, you may send us an email with the order number and your name to:

4. Should you wish to cancel the order, you may also send us an explicit statement containing your decision to withdraw from the contract or alternatively by transmitting the standard withdrawal form, as per Annex I, Part B, Legislative Decree 21/2014 which is not mandatory.

6. The goods must be returned intact, in the original packaging, complete in all its parts and complete with the enclosed tax documentation. Without prejudice to the right to verify compliance with the above, the site has up to 5 days to refund the amount of the products subject to withdrawal, including any shipping costs.
7. As provided for in Art. 56, paragraph 3 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the site may suspend the refund until receipt of the goods, or until you have demonstrated that the items have been returned.
8. The right of withdrawal does not apply in case the services and products of Circular-design.it are included in the categories set out in Art. 59 of Legislative Decree 206/2005.
9. The site will issue the refund to the same method of payment chosen by you at the time of the purchase. In case payment was made by bank transfer, and you wish to exercise your right of withdrawal, you must provide your bank details: IBAN, SWIFT and BIC required to issue the refund.
Art. 12 - Data processing
1. When you make a purchase, your data are processed in accordance with the provisions of personal data protection legislation, as specified in the section containing the notice pursuant to Art. 13 of EU Regulation 2016/679 (Privacy Policy).
Art. 13 - Safeguard Clause
1. In the event that any of the clauses of these General Terms and Conditions of Sale is null and void for any reason whatsoever, this will not affect the validity of or compliance with the other provisions of these General Terms and Conditions of Sale.

Art. 15 - Applicable law and jurisdiction
1. These General Terms and Conditions of Sale are governed by and construed in accordance with Italian law, without prejudice to any other overriding mandatory provision of the buyer's habitual country of residence. Consequently, the interpretation, execution and termination of these General Terms and Conditions of Sale are subject exclusively to Italian law.
2. Any disputes inherent and/or consequent to the same shall be resolved exclusively by the Italian authority having jurisdiction. In particular, if you have the status of Consumer, any disputes shall be resolved by the court of the place of domicile or residence of the same according to the applicable law.
Art. 16 - Online dispute resolution for consumers
The consumer resident in Europe must be aware that the European Commission has set up an online platform that provides an alternative dispute resolution tool.
This tool can be used by the European consumer to resolve in a non-judicial way any dispute relating to and / or deriving from contracts for the sale of goods and services entered into online.
